    If you continue to browse and use this Platform, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy & disclaimer govern One9 World Enterprises ("One9W") relationship with you in relation to this Platform.

    These "Terms of Use for Wellness Associates" (hereinafter hereinafter referred to "ToU-WA") govern your use of our www.wellnessway4u.com (the "Website") and our proposed application for mobile and handheld devices (the "App"). The Website and the App are jointly referred to as the "Platform". Please read these Terms of Use carefully before you use the services. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App if applicable. By installing, downloading or even merely using the Platform, you shall be contracting with One9W and you signify your acceptance to the Terms of Use and other policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy , Disclaimer and Shipping & Delivery Policy) as posted on the Platform from time to time, which takes effect on the date on which you download, install, register or use the Services, and create a legally binding arrangement to abide by the same.

    If you disagree with any part of these terms and conditions, please do not use our website. Further should you object to any term or conditions or any guidelines, or policy, or any subsequent modifications thereto or become dissatisfied with our Platform in any way, your only recourse is to immediately discontinue use of our site.
  1. The term "One9 World Enterprises" or "One9W" or "us" or “our” or "we" refers to the owner of the website/Platform.
  2. The term “User” refers to the user or viewer or member of our website/Platform who are availing Wellness related Content, products, services, (including Events such as Games, Contests, Workshops, Seminars, Programs, Polls, Survey, Product Sampling etc), features and information / advice / opinion on our website from us and/or Wellness Associates.
  3. Every Products & Services Providers registered on our website would be hereinafter individually and collectively referred to as "Wellness Associates" or "Vendor" or “You” or “Your”.
  4. www.wellnessway4u.com mission is to provide a versatile wellness ecosystem / platform to promote all-round wellbeing awareness, accountability, empowerment, & engagement in simple doable steps. It will also be a complementary support tool to all health & wellness professionals. To achieve this, our platform will be open to existing as well as unique third party wellness products & services such as Consultation, Games, Contests, Workshops, Seminars, classified advertisements , bulletin board, discussion, forums, including health assessment modules, health chart, report, market research and surveys and various other services (referred to hereafter as "the service").
  5. You have to Register yourself as a Wellness Associate at One9W as first step towards providing any of your products & services to our Users. To Register, You have to provide the requested basic information & accept the terms of use/terms and conditions by clicking I agree Button/Continue Button or Yes Button appearing in the website of One9W. Thus by doing so a binding agreement is/will be executed between You and One9W.
  6. Further You agree that the information furnished by You in the Registration Form is accurate, true and complete and the information will be maintained and updated during the subsistence of this agreement, so that it will remain true, accurate, current and complete.
  7. You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Services. Accordingly, you agree that you will be solely responsible to One9W for all activities that occur under your account.
  8. We reserve the right, at our sole discretion, to revise/alter/delete/modify /change any or all of these terms of use/terms and conditions at any time. Such modifications shall become effective immediately upon the posting thereof. You must review the terms of use/terms and conditions regularly to keep yourself apprised of any changes. Your continued use of our website will signify Your consent to those changes.

  10. Use of our site is available only to persons who are 18 years of age and above and persons who can enter into a legally binding contract, and who are not barred by any law for the time being in force. If you are registering with our site not as an individual but on behalf of a legal entity, then you should represent that you are fully authorized to do so and the posting, opinion or information placed on the site on behalf of the legal entity is your sole responsibility and you agree to be accountable for the same.
  11. Wellness Associate should strictly respect the privacy and rights of its members as detailed in the Privacy Policy on this website.
  12. Wellness Associates should clearly mention the Rewards in form of Points, Badges, Certificates, Vouchers, Products & Services etc with terms & conditions for Events (Workshops, Seminars, Games, Contests etc) that they will conduct & posted on our website. The updated information on points balance, redeeming will be accessible to both you & your registered participants from your respective Dashboard/Panel on the site.
  13. One9W at our sole discretion may or may not offers additional Rewards in form of Points, Badges, Certificates, Vouchers, Products & Services etc, change value of our rewards, our decision as per terms & conditions specified from time to time on our Website at User Terms (TOU-U).
  14. Wellness Associate should strictly follow the Shipping & Delivery Policy , Cancellations & Refund Policy detailed separately on this Website.
  15. You further agree that You shall not provide any inadequate or misleading or improper solution/ advice/opinion to Users on our Platform. You shall be solely liable to User for any physical, mental, monetary or other damages/loss sustained by Users due to reliance by Users on any advice/opinion/information, provided by You on our Platform.
  16. You agree and acknowledge that One9W does not make any make any representation, recommend, endorse or provide warranty or guarantee or confirm the validity, accuracy, completeness, safety, timeliness, usefulness, reliability, legality, quality or the applicability of any event/information / content / advice/opinion provided in this Platform, Blog by Wellness Associates to Users or vice versa. It is understood that you are providing advice/opinion /information to Users at your sole risk and responsibility and One9W shall not be liable for any act or omission of the User.
  17. Neither we nor any third parties make any representation, recommend, endorse or provide warranty or guarantee or confirm the validity, accuracy, completeness, safety, timeliness, usefulness, reliability, legality, quality or the applicability of the events, information, products, services and materials found or offered on this website for any particular purpose. You acknowledge that they may contain inaccuracies or errors and we expressly exclude liability for the same to the fullest extent permitted by law. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable.
  18. You should advise Users not to rely solely on advice/opinion given provided by You on our Platform for diagnosing or self treating a medical or health condition. We strongly recommend Wellness Associates to inform the Users to consult with a qualified Doctor/Physician / Medical Centres for a personal physical examination for User’s treatment. The Content of the Platform is not intended to be, nor is it a substitute for professional medical advice. The Platform and its Services do not, cannot and is not intended to replace the care and advise that only a qualified medical expert may give which may be upon due clinical examination of symptoms and / or co-relation of reports with such examination. Further, You should inform the User never to disregard professional medical advice or delay in seeking it because of something You have advised/informed User on this Platform. You shall be solely liable/responsible for any damages sustained by User on reliance of such report/ information/advice/ opinion/views etc. It is your responsibility to verify the credentials of User before any interaction. One9W does not assume any responsibility for any act or omission of any such User.
  19. While using our Platform, blog and participation in the Games, Contests, Workshops, Seminars, Market Research, Surveys & similar interactive activities, You should not post, transmit any content, details, data, information, material, which is in violation of local, state, national, international laws; which is unlawful, threatening, harassing, abusive, obscene, vulgar, defamatory, slanderous, libelous, hateful, racist, promotes violence, ethnically harmful or otherwise objectionable, as also determined by One9W at its sole discretion; which infringes on the intellectual property rights of others. You should not distribute viruses or other harmful code and will not interfere with or disrupt the Platform's servers or networks connected to the site.
  20. You will bear all the risks attached/associated to/with the uploading and transmitting of content/material while using our Platform.
  21. One9W in its absolute discretion may block or deny access to any User / You who is in violation of any of the terms of this Agreement.
  22. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
  23. From time to time, We may provide links to third party web sites or external websites/internal servers or resources including advertisements by others. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).We have no control over such sites and the information provided in them. One9W does not recommend and does not endorse the content on/off any third party web sites including that of advertisers. We are not responsible/liable for the content of these external sites nor do we endorse, warrant or guarantee the products, services or information, messages, accuracy, genuineness, reliability described or offered or advertised at these other external web sites. Any dealing/use by You with these external or third party website including advertising is between You and those websites/advertisers and is solely at Your risk. We reserve the right in our sole discretion and without assigning any reasons to you to delete, modify, block, deny access or discontinue, temporarily or permanently your account/participation/membership with us with or without notice to You especially if in violation of any of the terms of this Agreement.
  27. You acknowledge and agree that our Platform, the products and services are provided on "AS IS" and "AS AVAILABLE" basis. The use of the same is at Your sole risk & responsibility. One9 World Enterprises will not be liable whether express or implied, statutory or otherwise, including, without limitations, the implied warranties of merchantability, fitness for a particular purpose and non infringement, security or accuracy under any contract, negligence, strict liability or other legal or equitable relief thereby for any indirect, exemplary, special, punitive, consequential or incidental losses, damages, claims, liabilities, charges, costs, expenses or injuries (including death, physical, mental, without limitation, loss of use, data, revenue, profits, business and for any claims of any third parties claiming through You) that may arise out of or be caused in connection with or result from use/inability to us this website, products, services, content, participation in events, this agreement or any other obligations undertaken under the terms of this Agreement. We shall also not be liable for any delay, default, failure, breach of its obligations under this Agreement, if the same is caused by any acts or acts of Your omission or Users or any third party acting on behalf of You.

Notwithstanding anything contained, the aggregate maximum liability of One9W in connection with the obligations undertaken, regardless of the form or nature of the action giving rise to such liability (whether in contract, tort or otherwise), shall under no circumstances exceed INR. Rs.500/= (Indian Rupees Five Hundred only).

You acknowledge and agree to defend, indemnify and hold harmless One9 World Enterprises, its directors, partners affiliates/group companies, assigns, successors, employees, officers, agents, licensors, advisors, consultants and suppliers harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, legal fees, resulting from or alleged to result from Your Act or violation of these terms and conditions or by the Users / One9W.

Intellectual property : Intellectual property : All trademarks reproduced in this website, which are not the property of, or licensed to One9 World Enterprises, Chaitanya Wellness Research Institute belong to their respective owners. This material includes, but is not limited to, the design, layout, look, appearance, images and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. Unless otherwise stated One9 World Enterprises, Chaitanya Wellness Research Institute is the sole/exclusive owner of all the intellectual property and in particular all the patent rights, the copy-right/rights, trademarks rights, database rights, trade secret rights and patents in www.wellnessway4u.com and www.wellnessway4u.com/blog and in any software, application, graphics, text and other materials used therein. You may view, use or download a single copy of the material/content of this site & blog solely for your personal, internal and non-commercial use. You should not use, modify, publish, broadcast, transmit, transfer or sell, rent, lease, reproduce, create derivative works from, distribute, circulate, disseminate, perform, link, display or in any way exploit any product or intellectual property, in whole or in part, except with the prior written consent of One9W. We appreciate and value/recognize/respects the intellectual property of others and expects the same from its Users.   32. Governing Law & Jurisdiction : Your use of this website and any dispute arising out of such use of the website is subject to the laws of India. This website and the agreement herein shall be governed by and construed in accordance with the laws of Republic of India. The parties shall attempt to settle any dispute arising from and/or in connection with this Agreement by way of negotiation. If the dispute is not so resolved within 30 days, it shall be referred to and finally resolved by Arbitration by a Sole Arbitrator to be appointed by One9W. The Arbitration proceedings shall be held in accordance with the provisions of the Arbitration and Conciliation Act, 1996 as amended from time to time. The Venue and Seat of Arbitration shall be Mumbai. The language of Arbitration shall be English.
  33. This Agreement is the complete and exclusive statement of the agreement between the Parties which supersedes all proposal oral or written and all other communications between the Parties relating to the subject of this Agreement.

You agree and acknowledge that your use of this website and information/ opinion / advise provided by you on this website to Users does not entitle you to claim any kind of right, title, interest or ownership on the website or on One9 World Enterprises, Chaitanya Wellness. Your use of this website does not grant you nor provides you any right of ownership on One9W, Chaitanya Wellness. You further agree and acknowledge that the you irrevocably assign to One9W all rights, title and ownership on the contents posted by you and on the information/ opinion / advise provided by You on this website.
